A Canadian court has ordered the release of a man accused of raping a 15-year-old girl, after his lawyer argued that the girl hadn't actually committed a crime, the CBC reports.
According to the judge's ruling, the girl's alleged assailant, identified as 26-year-old Cody Nixon, has been charged with first-degree rape.
The victim's lawyer, however, argues that the girl didn't commit a crime because she didn't attend high school and didn't engage in any other sexual acts.
The judge says Nixon's actions don't meet the definition of rape because he didn't attend high school and didn't engage in any other sexual acts.
The victim's lawyer says he plans to fight the ruling in court.
